Understanding Negligence and Compensation
As you calculate damages for your car accident claim, you and your attorney will likely discuss how negligence, particularly Texas’s modified comparative negligence standard, will affect your case and potential compensation. Texas is what is known as a shared fault state. This means that the court will consider how much fault each party holds in your car accident. The at-fault party will then be responsible for paying damages proportionate to their percentage of fault.
So, if you were struck by another distracted driver at an intersection but the court finds you were traveling over the speed limit when the crash occurred, they could say you were partially responsible for the damages you suffered as a result of the crash. They may decide, in this case, that the distracted diver was 80% at fault and you were 20% at fault. As such, you would be entitled to recovery 80% of the total damages you suffered from the other driver. That is, if your total damages were $100,000, the distracted driver would pay 80% or $80,000.
A final note. If you are found to be 51% or more responsible for a crash, you cannot recover any damages. This is one reason it is important to hire an attorney as early in the process as possible.
