Ford Rollaway Accident Lawsuits

Ford Recalls 2.9 Million Vehicles for Transmission Defect, Rollaway Crash Risk

Thomas J. Henry is representing clients injured in accidents related to a transmission defect in certain Ford vehicles. This defect can greatly increase the risk of rollaway crashes and accidents, posing a significant hazard for motorists and non-occupants.

The recall affects more than 2.9 million Ford Escape, Ford Fusion, Ford C-Max, Ford Edge, and Ford Transit Connect vehicles.

Ford Receives More than 1,600 Warranty Reports and 230 Complaints for Transmission Defects

According to documentation from the National Highway Traffic Safety Administration (NHTSA), a bushing that attaches the shifter cable to the transmission in certain Ford vehicles can degrade or even detach. This can prevent the vehicles from shifting into the intended gear.

As a result, a vehicle thought to have been shifted into “park” may actually be in a different gear, allowing it to roll away. This puts motorists and individuals around the vehicles at significant risk of collision, injury, and death.

Ford admitted to being aware of the problem, citing more than 1,600 warranty reports and 230 complaints about the problem. The automaker is also aware of at least four injury reports and six property damage claims related to the defect.

What Vehicles are Being Recalled by Ford?

Currently, the following vehicles are covered by the Ford transmission recall:

  • 2013-2019 Ford Escapes
  • 2013-2018 Ford C-Max
  • 2013-2016 Ford Fusion
  • 2015-2018 Ford Edge
  • 2013-2021 Transit Connect

Ford Escapes currently account for 1.7 million of the vehicles recalled.

Be advised that the above list may not cover all vehicles affected by the transmission problem and additional model years and vehicle types may be added to the recall as more information is uncovered.

If you are unsure whether your Ford vehicle is part of the recall, you can check through the National Highway Transmission Safety Administration’s recall notification system.

Injuries Suffered in Rollaway Accidents

Rollaway accidents pose a unique hazard because they typically occur when the vehicle is assumed to be in “park”. Add to that the absence of a driver behind the wheel to take corrective action and you have a recipe for disaster.

Injuries suffered in rollaway accidents include:

  • Crushing injuries
  • Broken bones
  • Vital organ injures
  • Back injuries
  • Head injuries
  • Neck injuries
  • Paralysis
  • Death

A tort is a civil wrongful act committed by a person or company that results in harm to another person. A mass tort is when multiple victims are injured by the same single tort.
A court will consider if a mass tort lawsuit is permissible by determining:
  • whether a large number of plaintiffs are involved
  • whether the plaintiffs are located near or far from each other;
  • whether the injuries sustained are similar among the plaintiffs;
  • whether the claims arose from the same cause (defective toy, car part, oil spill, etc.)
  • Defective products, such as car parts, toys, or other consumer goods.
  • Pharmaceutical drugs, such as those that are later linked to severe or fatal health consequences
  • Environmental hazards, such as polluted water sources contaminated by nearby industrial sites or an oil leak.
Thousands of lawsuits across the country may be filed with a mass tort. These lawsuits are filed in numerous federal district courts. In a mass tort, federal judges will consolidate the thousands of lawsuits into a single proceeding. One judge in a single federal district court will oversee litigation, allowing for consistent rulings and a more expeditious process for the plaintiffs.
In a mass tort, each plaintiff (injured person) has an individual claim resulting from their unique damages. In a class action, many plaintiffs are considered collectively. Similarly, in a mass tort, each individual's claim "value" is unique to the severity of their injuries. In a class action, plaintiffs generally suffer injuries of similar severity, resulting in the same amount of compensation value.
