DWI stands for driving while intoxicated while DUI is driving under the influence. DUI's are issued to minors under 21 only in Texas. DWI's are more severe in penalty within the state of Texas. Some states do not distinguish between the two or use both.
Texas has a history of ranking as the top state in the United States for alcohol-related traffic deaths. According to the NHTSA (National Highway Traffic Safety Administration), around 1,468 Texans were killed in drunk driving crashes in 2017. Nationwide, one person dies every 48 minutes from alcohol-impaired crashes, according to 2017 statistics.
The legal limit for driving a motor vehicle in Texas is 0.08 percent for drivers over 21. Blood Alcohol Content (BAC) level must be below this percentage.
BAC is the medical or legal measure of alcohol within a person's bloodstream or on a person's breath. It is measured by milligrams (mg) of alcohol per 100 milliliters (ml) of blood. A BAC of 0.10%, for example, means that an individual's blood supply contains one part of alcohol for every 1,000 parts of blood.
